The case has gone to [livejournal.com profile] stop_plagiarism and they are investigating. Essentially someone will read both stories and make a decision

[livejournal.com profile] danceswithgary has done a comparison of the stories

Looking at the definition of plagiarism I still maintain I have done nothing wrong

Plagiarised work is presented so that it is still recognisably similar next to the original work. For example, a scrap of dialogue, or an image/metaphor that is the same in two pieces is NOT plagiarism.

Little or no further thought goes into plagiarised work, ie. text has been copied and pasted, perhaps with some minor alterations. Shared theme(s) between two pieces is not enough to constitute plagiarism.

Presenting plagiarised work with basic alterations to character, setting etc. IS still plagiarism. For example, if a Buffy fiction was presented to the Harry Potter fandom.


It's essentially down to the mod though. Just have to wait and see what happens

That sucks. This person is really being an ass about the whole thing. I really hope they decide in your favor. It's crazy and I've never seen anybody in this fandom do this.

I don't know how much faith I'd put in any LJ comm, which may or may not be fair and impartial, but I hope you win. This is so stupid!

Just as a f'rinstance: although I don't watch the show, from reading write-ups for the new Battlestar Galactica, at least one episode actually used an idea I'd written in a fanfic for the original series. Do I think the writers read my fanfic and stole the idea? Do me a favour!! Ideas are just ideas, and plenty of people have similar ones quite independently.

I think you're showing a lot of character, and I applaud you. This can't be easy for you in any way.

BTW, we used to do Star Trek plays at Toronto Trek. You'd be surprised how many of our lines ended up in the movies ;) Including Captain Kirk's "It's been fun."

Good luck. Having seen the two synopses of the stories concerned I have to say that it would suprised me immensely if you were accused of plagiarism as there are few similarities... *hugs*

If this is their definition of plagiarism, it seems sensible and correct. If they keep to it in their judgement is another thing, but if you had positive experience with them before, it should give you reason to trust them. Anyway, using a third pary seems like a fairly good way to solve things, way better than a my-friends-list versus your-friends-list fight anyway ;-)

i think going to this comm was a good idea. you're the one who suggested it, something a plagiarist would never do. i read through some of the cases there, and it's clear that the guilty wiggle around and lie and hide.

i hope the judgment is quick and fair, so that you're exonerated (so to say) very soon.

Greetings. I'm one of the mods in stop_plagiarism. We're received justforspite's post, but for now I'm leaving it in the queue. The reason being is that given the nature of the case I want to be able to give an answer on the heels of posting the post. I've made a copy of your story, I believe, so I can read it and compare it to Clover. Since Clover appears fairly lengthy, I've asked if Justforspite can send the whole thing to me as an attachment. It may take me a while to read and reply to the question raised, but I will.

The similarities are there, but no more than anyone else's story that has alien!Clark having a strong mating/bonding urge because of something about his alien nature or from a sex pollen...

The method of both stories was to have an artifact, Kare, Lana and Lex all involved, but that is pretty muuch where they stop being similar.

Your expression of a similar idea is totally different than how she expressed it so it's not "stealing" no matter what she thinks.

*HUGS* I've read [livejournal.com profile] danceswithgary's comparison and I don't see that many similarities. Yes, there a a few themes that are similar, but the plots are different. She betaed the story. She would have told you if you had accidentally walked on someone else's turf.

I think this is just becoming a nasty drama that isn't necessary.

Sad thing is, I was hoping the SV fandom was free of this sort of thing. :(

I've looked over both stories - even though I'm not in the SV fandom - and I see only minor similarities with some plot points. It's certainly not plagiarism. Copy and pasting with name changes is plagiarism. This is simply two people writing fics that share a few similar plot points. It happens in all fandoms. I can't tell you how many times I've done and seen icons/fanart that are similar in theme. When you have lots of people creating fic or art from the same basic characters, there are bound to be times that ideas are similar.
Besides, your track record of writing tons of stories goes to show that you don't lack fic ideas. You obviously do well with your creativity, and I see no reason to believe that you'd need to lower yourself to steal another person's idea. It would seem to me that the fact that you're well established in SV fandom, and a well established author should give a person pause in their accusations. Most cases of idea theft or plagiarism are conducted by those that are newbies, hoping to ride the talents of someone else into fandom. I've yet to see a well-established author do such a thing. It's simply not necessary.
I also wanted to vouch for [livejournal.com profile] stop_plagiarism, and spiralleds. It is a very solid community, and [livejournal.com profile] spiralleds is very through, fair and careful with the cases she investigates. I have no doubt that she'll look at the evidence, and see as I did that there was no deliberate intent on your part to plagiarise.

I've completely lost all respect for the other author, and I don't even know her that well at all.

I've removed myself from her community and I know that I won't be reading any of her fic: heaven forbid I get accused of plagiarism after I write a story about a boy named Lex and another named Clark, just like her!

I'm sorry that you have to go through this.
